Title IX Pregnancy-Related Requirements
New Regulation Update
The 2024 Title IX Regulations included the following updates related to pregnancy:
The definition of sex discrimination was expanded to include “sex-based harassment,”
sexual orientation, gender identity, pregnancy, childbirth, termination of pregnancy, and
related medical conditions and recovery. Schools must inform students and staff of their
rights related to pregnancy and pregnancy-related conditions.
Reporting a Pregnancy or Related Condition
When a student, or a person who has a legal right to act on behalf of the student,
informs an employee of the student’s pregnancy or related conditions, the employee
must promptly provide that person with the Title IX director's contact information
and inform that person that the Title IX director can provide supportive measures.
This notification requirement doesn’t apply if the employee reasonably believes that the
Title IX director has been notified.
School employees aren’t required to ask students about their pregnancy or about their
needs or medical status.
